If they actually said that (non-regimental) and left it there, then they already have crossed the line. But leave it and take the victory.
If they are going to check, then they are in violation.
It would be appropriate for them to draw your attention to any modesty policy. It's a new thing and they are developing a process. You know your own company and their response to modesty indiscretions.
(BTW, it would be discrimination, which is management action, rather than harassment, which is usually co-worker behavior.)
Make sure you have Human Rights protection, unless you're a federal employee, few states do. And not all rights are protected.
Not meaning to take this sideways. I'd like to see you work with them through this. You've actually become a pioneer. I'm not sure that anybody else here has had a policy change to specifically include kilts. Better to gently help them develop this than react (I recognize that you are not reacting here.) It would strengthen other, like Riverkilt, who don't have a policy and managers who are afraid to initiate one.
